Not every real estate agent is a realtor. The term refers to a member of the National Association of REALTORS®, over one million strong in the United States.
A REALTOR® can act as a buyer's agent, a seller's agent or a dual agent. A buyer's agent will provide you with all the information you need when considering buying a home. He or she will help you make a realistic offer, help you find a lender, arrange for inspections and other necessary steps and act as your liaison with the closing attorney. The buyer's agent will owe loyalty to the buyer only and will maintain confidentiality.
A seller's agent works for the firm that holds the listing on a property. His or her loyalty is to the seller. A seller's agent must disclose any material facts about a property to the buyer, but the seller's personal information remains confidential. Seller's agents get a commission on the sale price of the property, which may or may not be shared with a buyer's agent.
Dual agency is permitted in Kentucky but is subject to stringent regulations. Both the buyer and the seller must have given full and informed consent, and an Agency Information and Disclosure Form must be signed by all parties. Furthermore, a dual agent must disclose any personal, family or business relationships with any party to the transaction.
